Richie Sambora had his 10-year-old daughter in the car at time of DUI arrest

Richie SamboraBon Jovi guitarist Richie Sambora had his 10-year-old daughter Ava in the car with him at the time of his DUI arrest Tuesday night, law enforcement officials say.

Police would not confirm Ava's identity, as the incident is still under investigation.

Sambora's rep refused to comment.

"There were three females in the car, two of them were juveniles," Laguna Beach Sgt. Jason Kravetz says.

Kravetz says Sambora was stopped at around 10:52 p.m. Tuesday for swerving on the road in Laguna Beach, California. His breath smelled of alcohol, Kravetz says.

Kravetz says Sambora conducted "a series of sobriety tests" at the side of the Pacific Coast Highway. "The officer formed the opinion that Mr. Sambora had been operating his vehicle under the influence of alcohol," Kravetz says.

The results of Sambora's blood tests will be revealed in about a week.

Richie was released from jail at 4 a.m. He will appear in court May 7.

Last year, the 48-year-old rocker entered Utah's Cirque Lodge center at the same time as starlet Lindsay Lohan to help battle his addiction to booze.

He said he needed help after a string of problems in his life including his divorce from Heather Locklear all became too much.

Sambora told People magazine: "I got divorced from Heather Locklear, I was going through a custody battle, I was having alcohol addiction problems, my dad was dying "It was a gang tackle from hell, basically. And crawling out of that wreckage was a very triumphant victory."

Richie is a great guy, and a talented musician… who happens to be living in the real world…. he made a mistake and hopefully he’ll learn by it…
