Britney Spears and Kevin Federline due in court tomorrow

Britney Spears and Kevin FederlineBritney Spears and Kevin Federline are due back in the Los Angeles family court Tuesday for another round in their child custody case, a court spokesman confirms.

“It’s a hearing to discuss the status of [Britney's] case,” said court rep Allan Parachini.

Asked if her ex-husband, Kevin Federline, would show, his lawyer Mark Vincent Kaplan replied, “Kevin has been at every important hearing. I view Tuesday as an important hearing.”

The ‘Toxic’ hitmaker currently has monitored visitation rights with her sons — Preston, 2, and Jayden, 1 — several times a week, but no overnight privileges.

However, Kaplan says that his client is fine with more visits — but not right away.

“She needs to prove herself over time,” he explains. “We need to see that there is consistency and stability over a substantial amount of time, a slow ramping-up and not a spike.”

Spears, 26, returned to Los Angeles Sunday night after flying to Kentwood, La., to attend a baby shower for her pregnant 17-year-old sister, Jamie Lynn, over the weekend.

Britney’s father and lawyers remain in legal control of her personal and financial affairs until an evaluation hearing on July 31. The actual trial for custody is not yet scheduled, but Kaplan has said in the past that it won’t be until sometime in September.
