Kate Holmes’ rep has insists the actress is pregnant with her second child, despite reports to the contrary.

Holmes, 29, fueled rumors she was expecting after she spent over $2000 on baby wear at LA boutique Petit Tresor last week.

But a rep for the former Dawson’s Creek actress tells PageSix.com that the rumors aren’t true.

In December last year the actress – who’s married to Tom Cruise, Scientologist, admitted she’d love more kids with the 45-year-old ‘Top Gun’ actor.

“She had it all figured out,” a source told America’s People magazine.

“She would shoot her new movie and then get pregnant. She was hoping to have the baby by the end of the year, go back to work next spring and have another film out by the end of 2009.

“Both she and Tom – especially Tom – were hoping to have their next baby before Katie turns 30 in December.”

Britney Spears’ hospitalization has sparked an astonishing war between her parents and the people the star keeps closest to her.

The troubled pop superstar’s admittance to hospital in L.A. for mental evaluation finally brought about her parents’ wishes for her to be forced into getting help.

But even now, Spears and her right hand man Sam Lutfi are stopping her parents from taking control – even drawing up legal letters blocking them.

However her parents Jamie and Lynne feel those around her – including Lutfi and paparazzo boyfriend Adnan Ghalib – are a bad influence and are desperate to ultimately take her away from L.A. and home to sleepy Louisiana.

The events mean that even as she is in hospital getting help, a nasty battle for control is being waged in the hallways of UCLA Medical Center.

Now lawyers are being involved to try to sort out a legal mess – and it may take a judge to ultimately decide who should look after the troubled star.

An insider said: “Lawyers have been called and the tension in the air is thick.

“Jamie has been screaming at Sam in the hallway, accusing him of trying to control his daughter’s mind.”

Spears and Lutfi are said to have drawn up legal papers preventing her parents from making decisions over her healthcare after she was hospitalised earlier this month.

The fight surrounds who has the best interests at heart for Britney. Her parents Jamie and Lynne have been desperately trying to get her to seek help, and believe that Lutfi and those around their daughter are controlling her and encouraging her to make terrible decisions

But Spears herself has still not fully forgiven her parents for what she saw as betrayals over her divorce from Kevin Federline – and she still wants Lutfi to call the shots on her behalf. He insists that Spears “went willingly”.

Lutfi said: “It was like something in her heart was telling her she should go. “She knew something was wrong.”

The battle for control extends beyond hospital treatment.

Once discharged, Britney’s mother Lynne wants to take the singer away from temptations in L.A. and back to her childhood home of Kentwood, Louisiana.

“Lynne is extremely concerned for her daughter and would like to take Britney back home to Louisiana and get her out of Hollywood,” Britney’s lawyer Michael Flanagan said.

“Brit has an amazing support system in Louisiana.”

He added: “Lynne was holding up reasonably well, but her first priority and concern right now is with her daughter and helping her through this very tough situation that she is in.”

TRAGIC Heath Ledger – who had become a regular user of cocaine and heroin in the past year, reportedly got so high on drugs, his then girlfriend Michelle Williams was forced to boot him out of their Brooklyn home.

“She couldn’t take it any more. Heath wouldn’t show up for two to three days, and all of a sudden he would show up on her doorstep, an absolute wreck,” a source close to the 28-year-old ‘Brokeback Mountain’ star has claimed.

“He was partying, doing drugs. She didn’t like the company he was keeping. She gave him an ultimatum. . . . and threatened to get custody of the girl. He wanted to make it work, but it was this scene he was wrapped up in. Was he an addict? Yeah.”

The claims come as US television shows “Entertainment Tonight” and “The Insider” prepare to air a video of Ledger snorting cocaine with a rolled-up bill at the Chateau Marmont.

According to reports, the video was taped without Ledger’s knowledge following the SAG Awards two years ago. Ledger is heard on tape saying, “I’m gonna get so much sh*t from my girlfriend. We have a baby together, Matilda.” Matilda was 3-months-old at the time.

A pal who claims to have snorted cocaine with Ledger says the actor’s sudden rise to fame had him constantly exposed to drugs. As the pressures of work grew, he couldn’t say no, and then refused to get help. “He was hanging out with a bad crowd,” the pal tells the New York post. “He wasn’t cleaning up his act. He was making absolutely no effort . . . He was really into heroin. He wasn’t sleeping or communicating with anyone.”

Ledger was found dead in his Downtown Manhattan apartment last week along with six kinds of prescription pills.

Authorities believe he overdosed, although the cause of death won’t be official until toxicology tests are finished.

“At the end of the day this is really tragic,” the source said. “He was a nice guy. I first met him in 2002. He was scared about the whole Hollywood thing . . . I don’t think he realized how crazy it was going to be. So many people wanted a piece of him.”

But, the pal adds, things got really bad when heroin entered the picture. “Once you go down that road, then it gets really scary. Because all of sudden you shoot up, you take heroin, then you do a line of cocaine and then you take sleeping pills. Look at River Phoenix, he died exactly the same way.”

Ledger’s rep was unavailable for comment.

Following last night’s meticulously planned secret intervention, Lynne has decided that she is taking Britney out of L.A. as soon as she’s released from UCLA Medical Center. “Lynne is extremely concerned for her daughter and would like to take Britney back home to Louisiana and get her out of Hollywood,” Britney’s lawyer Michael Flanagan said.

Sunday and was shocked to see how badly the singer’s mental condition had deteriorated, feels that the biggest problem facing Britney’s recovery is the current circle of friends she keeps, and Lynne desperately wants to extricate her daughter from that. “Brit has an amazing support system in Louisiana,” Flanagan tells PageSix.com, reinforcing the belief that Britney simply can’t get the help she needs while she remains in Los Angeles. “Lynn was holding up reasonably well, but her first priority and concern right now is with her daughter and helping her through this very tough situation that she is in.”

The decision to finally bring her in for evaluation was made after Britney confessed that she had been up since Saturday – meaning more than 100 hours without sleep.

Those involved in planning to take her in decided they had to act instantly before the star went off the rails even more spectacularly then ever before.

It was clear when she was last taken to hospital, following a stand-off with police at her home after she refused to hand-back her sons, that her parents Lynne and Jamie wanted her taken in to care.

“Something like this has been in the works since she was last taken to hospital,” an insider said.

“The motorcade and everything was planned, it was already in the works to have them block off the road and airspace. It worked out perfectly.

“No one thought this would happen this soon, but it was clear if she stayed up for more than three days she’d have to get sent, since that could cause real damage.

“The last time she slept was Saturday.”

DAYS before Britney Spears’ meticulously planned intervention, the troubled singer’s mom, Lynn Spears “flew out” to L.A. Sunday and was shocked to see how badly the singer’s mental condition had deteriorated, a source close to the singer has claimed.

“Lynne was devastated,” a source tells Us Weekly magazine. “She hadn’t seen her in a while and to see her deteriorated to this level – what mother wouldn’t be affected by that? It’s awful.”

On Monday, Britney’s pal and self-styled manager Sam Lutfi phoned Barbara Walters, saying that the 26-year-old ‘Gimme More’ singer and her estranged mother were back on speaking terms and that Brit was having trouble sleeping and was suffering from “mood swings”.

Though the two appeared terse at a Beverly Hills Mercedes-Benz dealership Tuesday morning, The View co-host quoted Lutfi as saying, “her mother has been very supportive of whatever it is that Britney is trying to do.”

Last night the singer was taken to UCLA Medical Center in a “carefully orchestrated intervention,” the source says.

She “had been up since Saturday without any sleep,” other sources say.

Officials knew the troubled pop star was to be taken in for psychiatric evaluation and a specialist unit planned a motorcade to get her in safely.

Even the airspace above was closed off to protect Spears – and the motorcade stretched as long as a football field.

Throughout the operation, police and ambulancemen kept radio contact – with Britney referred to throughout as ‘The Package’.

The well-organized operation meant there were none of the chaotic and alarming scenes when she was stretchered out of her home in shackles the last time.

Insiders say Britney was also much calmer about the whole thing – even joking with those around her about it all.

Before the police arrived, her psychiatrist told her she was going back to the hospital and she offered no resistance.

“Is something wrong?” she asked, before making herself hot chocolate and waiting patiently.

But at one point she reportedly told her mum Lynne to “shut the hell up”, and  then sat on the floor and wrote notes to people who were there as they waited. When emergency personnel arrived, Brit went on the gurney without resistance.

“She’s more comfortable this time,” the insider said.

“She came into the waiting area, had a cigarette, made a joke about being there again.

“She’ll be in there for at least 72 hours getting evaluated. She might even stay longer.

” But who knows what will happen. All we can hope for is that she gets better.”

Britney Spears’ parents, Jamie and Lynn have been fighting with the troubled singer’s manager Sam Lutfi over who’s responsible for her medical care.

After Britney’s stay at Cedars earlier this month, she reportedly asked that her lawyers draft paperwork making it clear she did not want her parents involved in making medical decisions on her behalf. Her dad had was furious at the time, screaming and swearing at Lutfi – even pushing him in front of Britney.

After the fight with Lutfi, it was agreed that Britney’s parents would take responsibility for her medical treatment. TMZ.com reports that the doctors at UCLA, where Britney is on “5150 Hold”, are now “fully cooperating” with the parents in the treatment of the Toxic singer, however, the judge will need to sign an order to decide who has full control.

Sam Lutfi left the hospital before 4:00 AM; Jamie Spears also recently left.
