Stern, Dr. Sandeep Kapoor and psychiatrist Dr. Khristine Eroshevich will appear in front of a jury after a judge who heard sometimes shocking testimony about the flood of prescription drugs provided to Smith ruled Friday there was sufficient evidence to try the defendants on charges of conspiring to give Smith sedatives and opiates.

Defense lawyers had argued that the trio tried desperately to save the doomed model in her waning years, including a period when she gave birth to a daughter and lost her grown son to a drug overdose.

One of the last pieces of prosecution evidence introduced was a transcript of an investigator’s interview of a Smith friend who said she saw Stern placing pills in her mouth.

“He poured them in her mouth like you would a bird,” Gina Shelley said in the interview.

All three defendants pleaded not guilty, If convicted they each could face more than five years in prison. A Dec. 11 arraignment was set.

Eroshevich was the only defendant to comment after the hearing.

“I understand that I have to go through this process,” she said.

However, the former Playboy model — who was found dead in her suite at the Seminole Hard Rock Hotel & Casino in Hollywood, Florida in February 2007 — was never prosecuted, newly released files show, according to the Associated Press.

According to FBI records, which were released under the Freedom of Information Act, Smith was investigated in 2000 and 2001 for trying to have E. Pierce Marshall killed because he sought to keep her from inheriting his dad’s hundreds of millions of dollars.

Smith met her husband J. Howard Marshall when she was a stripper in Texas. She was 26 when she married the 89-year-old owner of Great Northern Oil Co., who died more than a year after they wed. In 1992, his wealth was estimated by Forbes to be $550 million.

The younger Marshall died three years ago of natural causes.

When informed by the FBI why she was being investigated, “Smith began crying and denied ever making such plans,” a document says.

An agent wrote at the time,”Smith adamantly denied ever contemplating such a crime,” and prosecutors eventually agreed the case could not go forward.

An April 26, 2001, letter to the FBI from Sally Meloch, an assistant U.S. attorney, said she reviewed the reports but “determined that there is insufficient evidence to establish that there was a murder-for-hire plot by Ms. Smith to kill Pierce Marshall.”

The FBI files show a .357-caliber Smith and Wesson revolver was confiscated from Smith’s home, along with a 3 1/2-inch stainless steel knife and, for reasons that were not explained, a black and orange hat described as “Dr. Seuss.” All three objects were returned to her about seven months later.

Anna Nicole’s diaries up for auction

Anna Nicole SmithAnna Nicole Smith’s diaries are set to go under the hammer again – just weeks after a German businessman paid $500,000 at auction for the journals.

The unnamed buyer purchased the diaries and other mementos during an eBay Internet auction and he already thinks he can turn his acquisition into a money spinner by re-selling the items in Dallas, Texas – Smith’s native state – later this month.

The two diaries, written in 1992 and 1994, were originally claimed by Anna Nicole’s former neighbour when he noticed the tragic model’s mother throwing memorabilia out as trash.

The journals feature Smith’s recollections of her first meetings with bosses at Guess Jeans, where she signed her first major contract, and expressions of love towards her then-husband, oil tycoon J Howard Marshall, who died in 1995.

Smith autopsy report set for release

Anna Nicole Smith’s autopsy report is set to be released on Monday, following weeks of speculation over the star’s death.

Brower County, Florida, medical examiner Joshua Pepper will release his findings at a press conference with Seminole Police chief Charlie Tiger.

Pepper postponed the determination of the cause of the tragic model/actress’ death last month after police provided him with additional evidence, admitting at the time it would take his staff up to five weeks to determine how the star died.

However, Pepper admitted at the February press conference his initial autopsy had ruled out “any kind of physical injuries, such as blunt-forced trauma, gunshot wound, stab wounds or asphyxia” as a cause of death, but added he “saw something that looked a little bit unusual” in Smith’s heart.

The former Playboy model was found dead in her suite at the Seminole Hard Rock Hotel & Casino in Hollywood, Florida on 8 February.

‘Significant’ evidence uncovered in Smith death probe

Police investigating the cause of Anna Nicole Smith’s death last month have uncovered “significant” new evidence – causing the coroner to delay releasing his findings.

The development comes as Smith’s bodyguard Maurice Brighaupt claimed the star’s boyfriend and lawyer Howard K Stern was behaving “highly strange” in the hours leading to her death in a Florida hotel room.

A police spokesman says: “This is not delayed evidence, this is additional evidence that has come to light during the course of the investigation.”

Coroner Dr Joshua Pepper adds: “This was unexpected. But this case has more turns than anything I could have imagined.

More exciting news from the world of ANS, as the former Playboy Playmate Anna Nicole Smith will be buried beside her 20-year-old son tomorrow in a custom-made gown after an extravagant private and “very pink” ceremony bringing together three factions battling for custody of her infant daughter.

The memorial service at Mount Horeb Baptist Church, next to a shopping mall west of downtown Nassau, will be “over the top”, with up to 300 guests, a singer and copious amounts of pink flowers, organiser Patrik Simpson said.

“It will be something very beautiful, very private, very over the top and very pink,” said Simpson, of Beverly Hills, California.

The burial at Lakeview Memorial Gardens & Mausoleums will be much more intimate, with about 30 people, he said.

The casket will most likely be closed during the ceremonies, said Simpson and Pedro Ferguson, managing director of the Bahamas funeral home handling the arrangements.

But Simpson said he and other close friends of Smith’s would arrange to put their pictures inside her casket before the burial.

Both the funeral and burial will be kept closed to the public with the help of Bahamas police. Today dozens of steel barricades were erected.

“We have the services of the police officers in the Bahamas and they are very competent,” said Ferguson.

Simpson’s partner, Pol Atteu, has designed more than a dozen gowns for Smith, including the one in which she was to be buried in a “very elegant” casket. Simpson declined to describe the dress, but said the whole ceremony will reflect Smith’s buoyant personality.

“It will be a very beautiful Anna Nicole send-off,” he said. “Of course it will be over the top because it’s Anna Nicole.”

Smith’s death of unknown causes in Florida last month set off a battle between her partner, Howard K. Stern; her mother, Virgie Arthur; and her ex-boyfriend Larry Birkhead over the burial and for custody of her infant daughter Dannielynn, who could potentially inherit millions. A Bahamian court has scheduled a custody hearing for mid-March.

Arthur had wanted to bury Smith in her native Texas. Birkhead lobbied for California.

But Stern insisted the former reality TV star wanted to be buried next to her 20-year-old son, Daniel, who died with drugs in his system while visiting Smith just after she gave birth in September.

A Florida appeals court resolved that dispute on Wednesday, and once Arthur decided not to appeal, Smith’s body was free to be flown to the Bahamas by private plane early tomorrow, said attorney Richard Milstein, the court-appointed advocate for Smith’s five-month-old daughter.

“Anna is coming home, where she wanted to be,” Stern attorney Ron Rale told Associated Press Television News. “Everybody knows that Anna’s intent was to be buried in the Bahamas.”

Simpson said each “faction” – Stern, Arthur and Birkhead – had to submit a guest list in advance and each would be limited to 100 people at the church service. According to Entertainment Tonight, country music singer Joe Nichols will also perform.

Simpson, 38, a talent scout who was friends with Smith for the past five years, said he and his partner plan to place photos of themselves with their 15-year-old daughter, who sang at Daniel’s funeral, inside her casket. Other friends will likely do the same, he said.

Despite the choice of a Baptist church for the service, he said Smith wasn’t particularly religious but was “spiritual.”

He recalled her as a warm and generous person who always remembered their daughter’s birthday and other special events.

“She was just a good friend, a good mother, a great person,” Simpson said. “She had a heart of gold and would give you the shirt off her own back.”

Anna Nicole’s body to leave for Bahamas tomorrow

Anna Nicole Smith’s body will leave for the Bahamas by private plane tomorrow morning, and the starlet will be buried hours later, said the attorney given control of her remains after weeks of legal fighting.

Police will escort a hearse before dawn to Miami International Airport for the trip to the Bahamian capital of Nassau, said Richard Milstein, the court-appointed advocate for Smith’s five-month-old daughter, Dannielynn.

The funeral will take place later that morning in Nassau, Milstein said today.

Both services are closed to the public.

The burial would close one part of the legal dispute surrounding Smith’s February 8 death in a hotel room at age 39.

Her boyfriend, estranged mother and an ex-boyfriend have argued over who gets the body and who gets custody of Smith’s baby daughter, who could inherit millions of pounds.

Smith will be buried next to her 20-year-old son, Daniel, said a friend helping to organise the memorial.

Somehow, I doubt this’ll be the final chapter in the long winded crap fest that is Anna-Nicole-Smith.
